The Workers Protection Act, which came into force in October 2024, introduced a new proactive duty requiring employers to take reasonable steps to prevent sexual harassment and anticipate when it may occur, including steps to stop third‑party harassment. Building on this foundation, the Employment Rights Bill further strengthens employer obligations by raising the threshold to require all reasonable steps to prevent harassment, expanding whistleblowing protections to explicitly cover sexual harassment, and introducing stronger enforcement measures and third‑party liability.
